UAE Visa Grace Period: What You Need to Know
How long is the UAE visa grace period?
As of 2024, the UAE provides a 60-day grace period for employees whose residence visa has been cancelled by their employer. During this period, you remain legally present in the UAE and are permitted to search for employment, change your visa status, or make arrangements to depart. The 60-day window starts from the date your visa is formally cancelled — not from your last day of work, which may be earlier. Confirm the exact cancellation date with your HR team in writing.
What can you do during the grace period?
During the 60-day grace period you can: legally remain in the UAE and continue your job search; apply for a new employment visa through a new employer; convert to a different visa type (investor, freelancer, student, or Green Visa); leave and re-enter on a new visa type; or arrange a visa change within the country without leaving. You may attend interviews, sign offer letters, and complete the administrative steps for a new employment visa — all of this is permitted.
Can I work in the UAE during the 60-day grace period?
No. The grace period permits you to remain in the UAE legally — but not to work. You cannot accept paid employment while your visa is in cancelled or grace status. You may search for a job, attend interviews, and complete the administrative steps to transfer to a new employer-sponsored visa. Beginning work before your new employment visa is formally issued constitutes a labour violation for both you and the employer. Some employers will request a no-objection letter from your previous employer to accelerate the transfer.
What happens if the UAE grace period expires before I find a job?
If your 60-day grace period expires without securing a new visa, you are required to leave the UAE. Overstaying beyond the grace period incurs fines — currently AED 25 per day after a 10-day buffer period. If you need more time, the right move is to convert to a tourist or visit visa before your grace period expires — this can often be done in-country and extends your legal stay. You can also apply for a UAE Green Visa or freelance permit if you meet the criteria. Do not allow the grace period to lapse unplanned.
Can I switch to a different visa type during the UAE grace period?
Yes — and doing so is often the right move if your job search needs more time. During the 60-day grace period you can convert to a tourist or visit visa extension, apply for a UAE Green Visa (5-year self-sponsored residency for qualified professionals and freelancers), apply for an investor or partner visa if you are starting a business, or arrange a spousal or dependent visa if a family member holds UAE residency. The process for in-country visa changes runs through the General Directorate of Residency and Foreigners Affairs (GDRFA) in your emirate.
Is the grace period extended in any cases?
Extensions are not granted automatically. If you believe your employer cancelled your visa unlawfully — without proper notice, without paying end-of-service gratuity, or in breach of your employment contract — you can file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE). Active legal disputes can sometimes result in extended legal stay permissions while the case is being processed. Free zone employees (DIFC, ADGM) should check their specific free zone authority, as dispute procedures differ.
What happens to your end-of-service gratuity?
Federal Decree-Law No. 33 of 2021 entitles employees to end-of-service gratuity after completing at least one year of continuous service. The calculation is based on 21 days of basic salary per year for the first five years of service, and 30 days per year thereafter. Gratuity is calculated on basic salary only — housing, transport, and other allowances are excluded. Your employer must settle all outstanding amounts including gratuity at the time of visa cancellation. If they do not, file a complaint with MOHRE (mohre.gov.ae) — most gratuity disputes are resolved through MOHRE mediation.
Are domestic workers and caregivers covered by the UAE grace period?
The rules differ for domestic workers. Under Federal Decree-Law No. 9 of 2022 (which specifically governs domestic workers including housekeepers, nannies, caregivers, and drivers), the grace period after employment ends is generally 30 days rather than 60 days. During this period, domestic workers may seek a new employer, arrange transfer through a licensed recruitment agency, or make departure arrangements. Working without a valid visa is not permitted. MOHRE's Tadbeer centres provide support, guidance, and legal assistance specifically for domestic workers in transition.
What if you're employed in a UAE free zone?
Free zone employees (DIFC, ADGM, JAFZA, DMCC, and others) may be subject to different frameworks from mainland UAE employees. DIFC and ADGM operate under their own employment regulations — in some respects these offer greater protections. For visa grace period purposes, the underlying UAE immigration rules generally still apply, but your employment rights disputes go through the relevant free zone authority rather than MOHRE. Always check your employment contract and the specific free zone authority rules before assuming standard mainland protections apply.
Practical steps to take immediately after visa cancellation
Within the first 72 hours: confirm the cancellation date in writing from your employer; ensure all outstanding salary and gratuity calculations are agreed in writing; request an experience letter or employment certificate while you still have leverage; back up all professional contacts, documents, and work samples you are entitled to keep. In the first week: update your CV and LinkedIn profile; activate your ILOE insurance claim at iloe.ae if eligible; reach out to your professional network; and start targeted applications. The first two weeks statistically produce the highest-quality job search activity — and your grace period clock has already started.
